3. Licensee understands that said horse is retired or a rescue, and that many conditions of horses are not obvious, and E.P.O.N.A. cannot know all the details of the horse�s history.� The responsibility for determining if the horse is fit for use by the Licensee belongs exclusively to Licensee.� Licensee acknowledges that the Licensee has been advised by E.P.O.N.A. to engage in the services of a licensed veterinarian and an experienced horseperson to evaluate said horse.� Licensee agrees to provide E.P.O.N.A. with a statement of findings by the veterinarian if one is engaged.� Licensee agrees to accept the horse as is, where is, subject to the return provisions of paragraph five. 4. Warrantees.� E.P.O.N.A. warrants that it has a good and clear title to the horse, free from any liens.� Licensee understands and agrees that the horse is licensed from E.P.O.N.A. without conditions or warrantees of any kind except as otherwise stated herein, including health, unsoundness, or fitness for a particular purpose. 5. Right of return.� At the sole discretion of Licensee and within seven (7) days of the execution of this adoption agreement, Licensee may return the horse for any reason, provided that the horse is returned in the same or better condition as received by Licensee and without injury.� If the horse is returned in poor condition, sic or injured, E.P.O.N.A. reserves the right to adjust the amount of refund due Licensee, including giving no refund, by deducting amounts required to return the horse to its original condition.� After the seven (7) day refund period, the amount of refund will be at the discretion of E.P.O.N.A.� E.P.O.N.A. agrees to take the horse back at any time (space providing) if Licensee can no longer care for the said horse, but no refund is owing to Licensee after the said initial seven (7) day period. 6. Standard of care.� Licensee agrees to provide adequate care according to the standards set by E.P.O.N.A. but are not limited to provisions for adequate feed, shelter, farrier and veterinarian care.� Licensee agrees to maintain the said horse in good health and to provide all necessary veterinary and farrier care at no cost to E.P.O.N.A.� In the event that Licensee fails to adhere to these guidelines and fails to maintain and care for the horse according to the tenets of good horse husbandry, E.P.O.N.A. reserves the right in its sole discretion to terminate this license and take possession of the horse.� Licensee agrees that E.P.O.N.A. shall have the right to inspect the horse and the facilities in which the horse is kept frequently as E.P.O.N.A. deems necessary. 7. Transfers and assignments.� Licensee shall not transfer or assign this License to a third party without the prior written consent of E.P.O.N.A., which consent shall not be unreasonably withheld.� In the event that Licensee fails to obtain prior written consent, this license shall be immediately terminated and E.P.O.N.A. shall be entitled to take immediate possession of the horse. 8. Breeding rights.� The horse�� MAY�� MAY NOT�� be bred.� Offspring produced from licensed mares remain the sole property of Licensee. 9. Limitations of use.� The horse is licensed for use only as set forth in this agreement.� The said horse may not be used for racing of any kind.� Entry into any race will automatically terminate this license, and E.P.O.N.A. will take possession of the horse. 10. Change of address and location.� Licensee agrees to notify E.P.O.N.A. of any change of Licensee�s address.� Change of horse�s permanent location is prohibited without written consent of E.P.O.N.A.� Failure to comply constitutes a violation of this agreement. 11. General health.� Licensee agrees to have the horse examined yearly by a licensed veterinarian, and to provide to E.P.O.N.A. a veterinarian�s certificate of health accompanied by a recent photograph of the horse. 12. Death of horse.� In the event of the death of the horse, Licensee agrees to notify E.P.O.N.A. within thirty (30) days, and to provide a cause of death statement from a licensed veterinarian within the thirty (30) day period. 13. Cost of recovery.� In the event that E.P.O.N.A. terminates this license and takes possession of the horse, Licensee shall be responsible for all cost of recovery, including but not limited to veterinarian examinations and treatment to return the horse to good health, legal fees, and transportation costs.
