A lawsuit against MGM Resorts in connection with charges for mismanagement of employees’ retirement fund has been authorized as a class action by a Nevada federal court.
Retirement Fund Mismanagement Lawsuit Against MGM Resorts Turns into a Class Action
Play USA reported that on October 19, Judge Jennifer Dorsey certified the lawsuit filed by Eboni Lucas and other plaintiffs as a class action.
The lawsuit has been going on for more than two years and may finally move toward a resolution after the judge’s decision to make it into a class action.
The case includes all MGM Resorts employees who have opted in for the company’s 401(k) Savings Plan since 2014. However, exempt from the class action are board of directors members, MGM Internal Compensation Committee members, Administrative Committee members, and any employees that decide to not take part in the class action.
The case was filed by Eboni Lucas and a few other plaintiffs back on December 4, 2020. They accuse MGM Resorts of breaching the Employee Retirement Income Security Act of 1974 by not properly managing the employees’ investments in the retirement fund offered by the company resulting in a loss of value.
More precisely the main charge included in the lawsuit is presented as follows: “Failing to objectively and adequately review the Plan’s investment portfolio with due care to ensure that each investment option was prudent, in terms of cost; and maintaining certain funds in the Plan despite the availability of identical or similar investment options with lower costs and/or better performance histories.”
The plaintiffs further highlight that due to MGM Resorts’ neglect of its duties, the employees who had opted for the retirement plan lost millions of dollars.
MGM Resorts disputed the claims by noting that bringing in smaller returns is not a legitimate reason to press charges for violation of fiduciary duty.
Another Class Action Lawsuit Against MGM Resorts Was Filed in Mississippi
MGM Resorts is the object of another class action lawsuit in Mississippi which was filed by plaintiff Leane Scherer.
She accuses the company of robbing its customers of small change on thousands of cash-out transactions, which results in major profits for the company.
When a player wants to cash out his winnings from a slot machine, MGM Resorts rounds the payout to the nearest dollar, which means that if the player has $100.50 to cash out the casino cage will only pay out $100, effectively depriving the customer of his change.

Numerous parties have been in the mix
An arrangement with Sorare would be a replacement non-fungible token (NFT) deal for the EPL’s provisional agreement with ConsenSys that ended up not being signed earlier in 2022. ConsenSys had attempted to renegotiate its deal with the EPL at a lower price after NFT market valuations fell significantly. The Sorare deal on the table is reportedly more lucrative than the revised proposal from ConsenSys.
EPL is also in discussions with Dapper Labs
There are rumors that the EPL is also in discussions with Dapper Labs for a similar type of arrangement. Dapper Labs currently works closely with numerous major sports organizations on similar projects, including the NBA and UFC.
Sorare currently provides digital assets for other sporting organizations, including the La Liga soccer league in Spain. It also already has a partnership in place with the EPL’s Liverpool FC. Some of the backers for Sorare include major Japanese investment group SoftBank and France’s superstar striker Kylian Mbappé.
The UKGC’s investigation into Sorare
Last October, the UKGC revealed that it was investigating Sorare to determine if it requires a UKGC license to operate in the region. The gambling regulator also warned that the company does not carry a UK license and that people should be careful if they have financial dealings with the platform. It is unclear if the investigation is ongoing or if it has concluded.
Sorare’s EPL proposal would see it offer an NFT-based fantasy soccer manager game through which users could buy, sell, and trade virtual cards of players.
At the time, a Sorare spokesperson stated that the company was “very confident” that it does not offer any type of gambling, a viewpoint shared by many legal experts with whom Sorare has consulted.

The CEO of Gaming and Leisure Properties Inc. (GLPI) said that, contrary to popular belief, he is interested in acquiring additional property on the Las Vegas Strip, if the right opportunity presents itself. In an earnings call on Friday, Peter Carlino admitted, in a bit of a surprising mea culpa for someone in his position, that his predictions for the Strip’s emergence from the worst of the pandemic were wrong.

“I’ve been chastened a little bit following this latest downturn and recognizing after COVID that the Strip proved to be a lot more resilient than I would have ever have guessed,” Carlino said. “We knew what would happen in the regional markets with people the first minute they could go out of their door would head over to our properties and did so with great enthusiasm. But Vegas, I was a little bit more cautious about it and I was wrong, frankly.”
GLPI owns the land on which the Tropicana Hotel and Casino sits, as well as 57 gaming properties across 17 states. It sold the Trop to Bally’s Corporation in April 2021 for $150m and then agreed to lease the land to Bally’s for $10.5m per year for 50 years. Penn National was the Tropicana’s operator; it sold its remaining interest in the property to GLPI as part of the deal.
It’s just business
In the earnings call, Carlino said that his company was never against expanding on the Las Vegas Strip, it simply preferred “regional” casinos from a value standpoint.
“It’s only about money,” Carlino explained. “There’s nothing that we won’t own, I go both directions. We’d love to have Strip properties. I’ve often said to many of you that I’d own a shack on the beach with no windows and doors if the cash flow was rock solid.”
Bally’s Corporation will likely rebrand the Tropicana as a Bally’s. The current Bally’s Las Vegas will change its name to Horeseshoe Las Vegas in December. Bally’s Corp. chairman Soohyung Kim said in January that it is possible that his company could decide to raze the Trop and start from scratch if it makes the most financial sense.
Caesars is looking to shed a Strip property. One that has specifically come up is the Flamingo, which the company reportedly wants to sell for at least $1bn. It is unknown if GLPI has any interest.
Las Vegas A’s?
The Tropicana has also been at the center of negotiations for a possible move by MLB’s Oakland A’s to Las Vegas. Late last year, CNBC reported that the team has targeted the site of the Tropicana for its new stadium, should it move.
In the earnings call, Carlino did not provide any new information on possible negotiations. While it is not a guarantee that the A’s will move, MLB commissioner Rob Manfred said on Sunday that it is probably going to happen. The team’s stadium is arguably the worst in the league, its lease runs out after the 2024 season, and it has not been able to secure a deal with the city to build a new one.

The Dallas building official who filed a lawsuit against the city’s Board of Adjustment and Texas Card House won in court, dealing a swift blow to the Texas poker community, but it was far from a knockout punch.
Although the victory for plaintiff Andres Espinoza could be seen as damaging for card rooms across the state, the fight continues. Texas Card House Dallas will soon begin the process of filing an appeal.
Last month, in preparation for the Oct. 25 court date, Texas Card House CEO Ryan Crow told PokerNews he anticipates the case will eventually end up in the state’s Supreme Court one way or the other. If he’s correct, an unfavorable ruling could serve as a death blow to poker rooms in the Lone Star State.
Bad Day for Texas Poker, But Not the End of the World
In January, TCH Dallas was slapped with a Certificate of Occupancy revocation despite its business model being approved by the city in 2020. In fact, the same city council member who originally backed the business plan has since gone back on his word. The card room has remained open while fighting what will inevitably turn into a lengthy legal battle.
Two months later, the Dallas Board of Adjustment voted in favor of TCH’s appeal, a major victory for the poker club. But, shortly after, interim city building inspector David Session, vowed to sue the BOA for, as he claimed, illegally reversing the COO decision. On Thursday, three days after the mini trial, District Court judge Eric V. Moye agreed.
“The Court finds that the Board of Adjustment abused its discretion and made an illegal decision when it reversed the Building Official’s revocation of Certificate of Occupancy number 2003031040, which was issued in violation of state law to ‘Ryan Crow’ DBA ‘Texas Card House,’ the judge wrote in court documents obtained by PokerNews.
What the Law Says
In the state of Texas, poker rooms such as TCH operate as social clubs and charge membership and seat fees instead of taking rake out of cash game pots. They do so because collecting rake is illegal, but some lawmakers argue the same can be said about the club-based model.
Texas Penal Code 47.04 states that so long as the gambling occurs in a private place, no economic benefit other than personal winnings were received from the game, and that every player had an fair shot at winning, the game is legal.
The definition of “economic benefit” has been debated across the state, with some officials arguing the term implies that as long as rake isn’t collected during the games, the poker is legal. Others, however, claim that any form of gambling in Texas is illegal regardless of how and where the games are played.
One of two things will likely happen, perhaps within the next couple of years: the Texas Supreme Court will determine the legality of poker via the ongoing Texas Card House case, or lawmakers will reword the letter of the law to clear up any confusion.

While the province of Ontario, where up to a third of all Canadians live, has embraced a free-market approach to online gambling and sports betting, the mighty province of Saskatchewan is just now embracing online gambling with regulation occurring in Canada and revenues distributed at home.
The Saskatchewan Indian Gaming Authority (SIGA) has announced it will launch a casino and sportsbetting site under the PlayNow brand on November 3, 2022. The gambling site will be operated by the Saskatchewan Gaming Corporation (SaskGaming) and will be the only site in the province to hold a license based in Canada.
Most online casinos that are located offshore serve Canadians, no matter which province or territory they live in, but they are usually either licensed by the Malta Gaming Authority, Caribbean regulators (Curacao), or by the Kahnawake Gaming Commission located in the Mohawk Territory of Kahnawake just outside Montreal, Quebec.
Last September, an arrangement between the provincial government and the Federation of Sovereign Indigenous Nations (FSIN) to get the online gaming site off the ground was agreed to by the parties.
The betting platform will be provided by the British Columbia Lottery Corporation (BCLC) and based on the PlayNow.com site the crown corporation runs in British Columbia. A similar site under the PlayNow domain is also active in Manitoba, with the SaskGaming making a total of three “PlayNow” destinations.
Specifically for Residents of Saskatchewan
The sites use geolocation software with the BC site meant only for players in that province and the Manitoba site for players in the province between Saskatchewan and Ontario.
SIGA will be the official operator of PlayNow.com in Saskatchewan as per an operating agreement with SaskGaming.
“We are excited to be the exclusive provider of Saskatchewan’s first and only legal online gaming site, which will provide a safe and secure option for residents to play their favorite casino games and bet on their favorite sports teams online,” said SIGA President and CEO Zane Hansen.
FSIN chief Bobby Cameron added: “This historical partnership is the first of its kind with a First Nations operator for online gaming, with revenue sharing between First Nations and the province. This will provide many economic benefits to the residents of the province and our First Nations communities.”
SaskGaming President and CEO Susan Flett said: “The rollout of online gaming and single event sports betting opens up new casino entertainment options for residents,” “The launch timing is also ideal with Saskatchewan hosting this year’s Grey Cup in November.”
“Residents will be pleased to know that when they play on the PlayNow.com site, the proceeds are reinvested back into the province,” said Hansen.
“Similar to the existing brick-and-mortar casinos in the province, all net proceeds from the PlayNow.com site are reinvested back into Saskatchewan,” he said.

But how exactly do these casinos differ from others around the US?
1. Tribes Don’t Pay Taxes On Casino Income, But Employees And Winners Do
There’s a bit of confusion around Native American casinos and tax.
In reality, it’s all quite clear. The federal and state governments are not allowed to charge taxes on the tribes’ activities.
This means that the casinos don’t need to pay taxes to the federal or state governments, including on commercial or business incomes.
However, there are usually still compacts and stipulations that see casinos paying local counties or states a portion of the profits.
When they pay out funds as salaries or profit sharing to tribe members, that income is taxable. However, individuals who are given money under general welfare or social benefit programs do not have to pay tax.
For players, taxes apply as normal, so if you win money at a Native American casino the IRS wants to know about it.
Casinos can also issue win/loss statements using loyalty card transactions to help when people are filing taxes, too.

During the same year, the Las Vegas Strip brought in $7 billion in GGR. These amounts are before salaries, management costs and other expenses.
Of course, this comparison is not entirely fair as it pits the combined revenues of around 500 tribal-owned casinos against the approximately 30 casinos found on the Las Vegas Strip.
But it still shows us that, while the Las Vegas Strip gets all the attention, there is serious money to be made by running casinos on sovereign Native American land.
3. Security Guards At Tribal Casinos Have The Power To Detain, But Not To Arrest

In Las Vegas, the security officers are only allowed to watch and report, bringing the police in should any crimes take place.
At Native American casinos you’re on sovereign land. This means that the Indigenous police are usually guarding the casinos.
Because of this it is in their power to investigate crimes, search suspects, and detain non-Indigenous people.
However, Indigenous police forces are only allowed to arrest and persecute other Native Americans.
The fact they are limited in the arrests they can perform often means Indigenous police forces have to wait for non-Indigenous police forces to arrive and formally complete arrests.
4. Palms Casino Resort Is The First Casino In Las Vegas To Be Owned By A Native American Tribe

Palms Casino Resort is a 703-room hotel and casino resort that was first opened in 2001.
After changing hands a couple of times, Station Casinos purchased Palms Casino Resort in 2016 for $312.5 million. The company then paid for a $620 million renovation.
Like other casino resorts in Las Vegas, Palms closed at the beginning of the Coronavirus Pandemic in 2020. This, amongst other reasons, led Station Casinos to list Palms for sale.
In May 2021 it was announced that the resort would be sold to the San Manuel Band of Mission Indians for $650 million.
This sale marked Palms as the very first Las Vegas casino resort to be owned by a Native American Tribe and it re-opened after a two-year closure on April 27, 2022.
Speaking before the sale was finalized, CEO of the San Manuel Band of Mission Indians, Laurens Vosloo, said:
“It’s the gaming Mecca of the world and the place to be. It’s a natural and a good fit for us to have an asset there that we can send our customers to, contribute to that economy and be part of the Las Vegas community.”
5. Games Aren’t Regulated In The Usual Way

Casino games at tribal casinos aren’t regulated like Las Vegas casinos.
Instead, they must adopt a gaming ordinance approved by the National Indian Gaming Commission. This determines the casino’s payment schedules and payout percentages.
What’s more, there aren’t clear rules about displaying these payout percentages, so many gamers won’t know the odds they are coming up against.
However, this doesn’t mean that Native American casinos are tighter than other casinos elsewhere. Some casinos might even have looser odds.
It’s important to remember that because each casino can follow different rules, most experiences are purely anecdotal.
In general, though, it appears that the table games are more generous at tribal casinos, while slots are a bit tighter.
6. Native American Casinos Are Some Of The Biggest In The World
Many of the world’s most famous casinos, such as the MGM Cotai and The Venetian Macau are well known for their massive gaming spaces.
The MGM has around 500,000 sq. ft. of gaming space. The Venetian Macau, a whopping 546,000.
However, the casino with the largest gaming space in the world is the WinStar World Casino and Resort in Thackerville Oklahoma, a casino owned by the Chickasaw Nation.

This casino boasts an incredible 600,000 sq. ft. of gaming space; that’s nearly the size of 10 and a half football fields!
Another massive, Indigenous-owned casino is Foxwoods Resort Casino in Ledyard, Connecticut.
Owned by the Mashantucket Pequot Tribe, Foxwoods offers 344,000 sq. ft. of gaming space – making it 2.7 times larger than the gaming space available at Caesars Palace.

7. Although They Own The Land, The Tribe May Not Run The Casino
Indigenous land is sovereign, but that doesn’t mean that all casinos found on Indigenous land are run by Native Americans.
Just like any business, Indigenous-owned casinos frequently turn to investors, advisors and managers to aid the success of their business.
For example, before its merger with El Dorado Resorts, Caesars (through Harrah’s) managed Native American casinos for years.
At the time of the merger these included Harrah’s Ak-Chin, outside Phoenix, Harrah’s Cherokee Casino Resort and Harrah’s Cherokee Valley River Casino and Hotel in North Carolina.
What’s more, famous businessmen have also been involved with tribal casinos over the years.
Lim Goh Tong partnered with the Mashantucket Pequot Tribe for Foxwoods Casino, and Donald Trump partnered with Twenty-Nine Palms Band of Mission Indians of California to open what was then called Trump 29 Casino.
8. Native American Casinos Improve Local Employment Rates
One of the key benefits of Native American casinos is that they provide a ton of jobs for locals.
Research highlights that casinos result in both a 26% increase in local employment rates and a 14% drop in the number of working poor.
Casinos have also been shown to cause an 11.5% boost in reservation populations. This is thought to be because the good employment opportunities allow Native Americans to move back to the reservation.
Other markers of poverty, such as childhood obesity, also declined in Indigenous communities that were close to a Native American casino.
9. Casinos Can Negatively Affect The Local Indigenous Community
Unfortunately, developing casinos on Indigenous land can result in a list of negative effects as well.
These include a 10% increase in violent crime, a 10% increase in car theft, and an increase in bankruptcies of those who live within 50 miles of the casino.
This is nothing new; casinos have been shown to increase crime pretty much everywhere they are built.
However, it is thought that Native Americans are at an increased risk of developing gambling addictions when compared to the wider American public.
This has led people to wonder if building casinos on reservations is something that benefits or harms the tribe.
10. Tribes Use Profits From Their Casinos To Build Infrastructure And Fight Inequality
Many people assume that, with such a huge market for local casinos, all Native American communities must be flush, too. This couldn’t be further from the truth.
Native Americans are still one of the most impoverished populations in the whole of the United States.
One of the key reasons for building casinos is to improve the lives of the Native American population.
But it’s important to point out that even if the casino is profitable the individual members of the tribe don’t really get profit sharing or additional cash.
Instead, the tribes generally use the money to invest in improving infrastructure, education services and healthcare.
For example, the Muckleshoot, a tribe based in Washington, have used income from their casino to build a medical and dental facility, and to construct homes for the elderly.

What’s even more impressive is that Native American tribes often give a large proportion of their earnings to charity.
The Muckleshoot Tribe gives away over $3 million annually to local governments, schools, churches, and non-profit organizations.
