UK Gambling: Affordability Checks Under Fire Again

UK Gambling: Affordability Checks Under Fire Again

Although this might seem like a good thing to most, the inadequacies of the UKGC in recent years have some horse racing aficionados worried that the reforms and their execution might negatively affect punters.

It’s just six weeks until the Cheltenham Festival, and some Racing Post articles are increasingly paying attention to UK’s long-awaited gambling reforms. Affordability checks are put under the spotlight again, and – according to Racing Post – they might bring more headaches than solutions, as trust in the UK Gambling Commission (UKGC) has been steadily eroding recently.

According to a Racing Post opinion piece, affordability checks might cost British racing quite dearly. It agreed with UK’s gambling minister Paul Scully that it’s not for the government or the UKGC to tell adults how much of their money they are allowed to gamble away. That’s not how some operators react to the still-upcoming gambling reforms in the country, though.

Some had already started implementing affordability checks as a standard approach preemptively, guessing that the measure will be implemented soon anyway. The pressure for affordability checks has, according to Racing Post, been brewing for at least 12 months, so the recent implementation naturally caused heated discussions when it became official.

The actual concerns are very nuanced, though, with different sides fearing different setbacks. As it is with any good story, there are many angles to look at, and Racing Post has made it clear that – at least the author of the opinion piece, Lee Mottershead – supports adults having the right to pick their own budget allocation for gambling.

Complex Situations Call for Complex Measures

Unfortunately, it’s not really that simple, as not everyone is in the right state of mind when making such decisions. Problem gambling – like any other addiction – affects decision-making. It’s not news to anyone, then, that the problem is so complex, it cannot have a blanket solution for any of its facets. Affordability checks are one example of that.

While it might seem restrictive for the average punter, it could also help stop someone from ruining their lives by betting beyond their means. It’s not like the latter is not exemplified or is a theoretical possibility – people are suffering from the lack of regulatory updates in gambling throughout the UK, and some of the harm is caused by just that problem.

On the other side, however, Racing Post’s notion that players – and by extension, the industry – will suffer from receiving sporadic bans over botched affordability checks, is also somewhat valid. The fear that this potential problem can be exacerbated during increased betting activity, such as the upcoming Cheltenham Festival, is also very sensible, as big events draw a lot of punter attention.

So, it all boils down to how much confidence the UKGC inspires in people that it can do it right. And, given the history of how it got to where it is now, the odds are stacked against it. However, people’s health should always come first, as the only way gambling is sustainable, is if its potential harms are limited as much as it’s feasible to do so.

Felix Schneiders: His Journey from Streaming Poker in his Basement to the PSPC

Felix Schneiders: His Journey from Streaming Poker in his Basement to the PSPC

It’s been almost ten years since Felix “xflixx” Schneiders joined PokerStars. Over the years his role within PokerStars has shifted — initially joining as a member of Team Online before now being part of a varied and hugely talented team of Ambassadors.

Schneiders is in The Bahamas for the PokerStars Players NL Hold’em Championship and spoke to PokerNews about his almost a decade working with PokerStars, the changes he’s made to his content and the poker journey he’s on within the German-speaking community.

Follow Updates from the 2023 PokerStars Players Championship

Changing Things…For The Better

“It really has been a long journey,” Schneiders told PokerNews. “And it’s taken a lot of turns that I wouldn’t have expected. I started out as a cash game streamer, streaming in English and building an English community.

“Then I switched to German. And it clicked. It resonated with me more, I became more natural on camera and it just helped me to be a better streamer.”

Sunday Million Where Poker Dreams Are Made says Felix “xflixx” Schneiders

Schneiders said the community initially shrank as viewers adjusted to the change in language, but when the dust settled the positives vastly outweighed the negatives.

“There’s really no better feeling than winning a tournament, and getting to share those moments on stream was great”

“It was more intimate and it was more relatable for my audience. I mean, most of them were German to begin with so it wot more of a community that continued to grow from there.

“Another switch was switching to tournament poker, which is something I never expected I would do. And now I can’t get enough of tournament poker. It’s so good.”

Having never anticipated this switch from cash games to tournaments, Schneiders says the change was as unexpected as it was overwhelmingly positive.

“At heart, I’m still a cash game player, and I always used to grind cash games. But it’s just way more fun to play tournaments. There’s really no better feeling than winning a tournament, and getting to share those moments on stream was great.”

Onto the Live Scene

Another huge switch for Schneiders was to take things out of the basement and onto the live poker scene. With PokerStars offering one of the strongest live poker brands in the world, it made perfect sense for Schneiders to take his community of poker fans and introduce them to the live felt.

“I had never done that before,” Schneiders admits. “I was always an online kid just nerding it up in front of my computer. But I realized there’s more than life to online poker.

“Poker gives you the freedom to travel, to meet people, and to just do crazy things and live life. That’s what I tried to do last year, and it was a hell of a ride. I went to all the Road to PSPC stops just to cover that series, which was crazy because everyone was just so hungry for live poker”

“Poker gives you the freedom to travel, to meet people, and to just do crazy things and live life”

As a result of the switch, Schneiders’ content changed entirely along with the team that came along with him to help create it.

“We did only Live Poker. I built up a content team to help me along on the journey, with moderators who were familiar with my stream and my content. So they started helping me joining as a cameraman or content editor. And we experimented with so many different types of content, and we really started to enjoy this.

Felix Schneiders

“So my content has evolved from a solo cash game streamer online, to this whole community-drive community-based style of content from live events all over the world.

“To travel the world and to travel to different places, to stream and to get to share this with everybody it’s the most amazing experience.”

Germans at the PSPC

Now at the PSPC the German-speaking community is well-represented, something that Schneiders is relishing.

“I’ve met a lot of people — even Platinum Pass winners — who come up to me who used to watch my content. And there’s this amazing connection. They used to watch my stream endlessly and now they’re here at the PSPC after winning a Platinum Pass. The connections still remain even after all these years — it’s crazy.

“There are Platinum Pass winners who are completely outside of the live poker scene, who maybe have never played live poker before. And they’re here for the first time. So it’s super important that they have people to cling to and to connect with.”

German Soccer Player & Olympian Max Kruse Wins WSOP Bracelet

Over the next five days, Schneiders will be cheering on the community of German-speaking players hoping that one will follow in Colillas’ footsteps.

Felix Schneiders

“It’s a lot different to the last PSPC. [In 2019] we were a small group of people, and we really felt that it was important to have this team spirit. This time we’ve decided to just get as many German-speaking people from the community together — from Germany, Austria, Switzerland. Just basically so they feel supported and they’re here together with other people and they’re not on their own.

“We want to make sure they have people to talk to. That’s so important in poker, to have a community of people you can vent to, or to bring you food, or just to rail you when you go deep. It just gives you a lot of stability.”

Judge Stymies Gov. Phil Murphy’s Ban on Guns in New Jersey Casinos

Gun in belt

Siding with gun advocates

US District Judge Renee Marie Bumb has blocked part of New Jersey Governor Phil Murphy’s short-lived law banning guns from multiple public spaces.

one month after Gov. Murphy signed off on the gun ban bill

On Monday in Camden, New Jersey, the federal judge blocked bans on carrying guns at casinos and beaches. The move comes just one month after Gov. Murphy signed off on the gun ban bill once it had passed through the state’s House and Senate in December.

The ban resulted in a lawsuit triggered by seven individuals and the Association of New Jersey Rifle and Pistol Clubs (ANJRPC). When the group filed the lawsuit, its executive director Scott Bach said Murphy’s law would “go down in flames.”

Ban unconstitutional

Essentially, the ANJRPC and other plaintiffs argued that the ban went against the Second Amendment, otherwise known as the right to bear arms. The judge at least partially agreed with their argument, ruling that the ANJRPC and the other plaintiffs “demonstrated a probability of success on the merits of their Second Amendment challenge.”

Murphy’s immediately enforced but short-lived Section 7(a), Subpart 18 of the December legislation prohibited firearms in “a casino and related facilities.” All New Jersey’s nine casinos are located in Atlantic City.

While Bumb’s rulings are not final judgements but temporary restraining orders, it prevents enforcement of the gun bans while the lawsuits proceed. In a statement released on Monday, Bach said the judge’s order “marks the beginning of the end for Governor Murphy’s blatantly unconstitutional new carry law.”

Judge Bumb does have a history of siding with gun advocates. This decision comes three weeks after she ruled in favor of a lawsuit brought by different plaintiffs, blocking bans on carrying guns in restaurants, bars, public libraries, and museums.

Back to the courts

In relation to the judge’s decision, a Gov. Murphy spokesperson said: “We look forward to being able to appeal the ruling and are confident that it will be reversed.”

Murphy and his lawmakers passed the gun law following a Supreme Court ruling in New York State Rifle & Pistol Ass’n, Inc. vs. Bruen. The Bruen ruling held “that the Second and Fourteenth Amendments protect an individual’s right to carry a handgun for self-defense outside the home.”

Are Loot Boxes Legal in the Netherlands ▷ Facts and Details

Loot Boxes

As an introduction to the topic, we will begin this informative blog post by addressing the definition of loot boxes. Once that is done, our article will inspect the situation with the loot boxes in the Netherlands, and discuss the latest political movements in that regard. To top all of this, we will look at some of the most popular online games that offer loot boxes and see their availability in the Netherlands. Let’s begin right away.

Loot Boxes – A Quick Summary

Loot boxes are features in video games that can be exchanged for in-game currencies, items acquired through gameplay, or purchased with real-world money. Depending on the exact game that we are talking about, the shape and form of the “loot boxes” may vary, but their content remains similar.

By opening a loot box, online players can obtain various items. Some are cosmetic, like hero outfits, skins, pets, and mounts, and do not affect the gameplay in any way. Other loot boxes are presented like the bonus offers of the best Dutch online casinos. In other words, they contain cards, characters, or items that might even give you an edge over the free-to-play users.

The loot box concept first appears in massively multiplayer online role-playing games (MMORPGs) between 2004 and 2007. Since then, the feature has only grown in dept and number as it continues to appear in many titles even to this day. The loot boxes were mostly popularised by colossal titles like Star Wars Battlefront 2, CS: GO, Overwatch, FIFA, and others. That said, let’s take a look at the top loot boxes games in the NL below:

  • FIFA (Top Football Game with Loot Boxes)
  • Diablo Immortal (Popular Mobile Game with Loot Boxes)
  • Lost Ark (Outstanding Gameplay & Available Microtransactions)
  • Overwatch (Great FPS with Free-To-Play Loot Boxes)
  • World of Warships (Offering Loot Boxes with Expected Value)

It is important to point out that by no means do we advertise or encourage you to launch any of these games and conduct microtransactions. In fact, as you will find out later in our blog post, the Dutch government considers the distribution of some of these games’ loot boxes illegal. But we will get into that in a bit.

Netherlands – Legal or Not?

Now that we have clarified what loot boxes are, it is time for us to find out how this monetisation is doing in the Netherlands. Currently, the northern member of the Benelux does not consider loot boxes a form of gambling; thus, they are not named illegal. However, the government had continuously raised concerns about the unregulated selling of loot boxes.

Currently, there is a motion in the Dutch government that prompts for amendments to the Netherlands’ gambling laws and placing a ban on loot boxes. One of the main reasons for that was the FIFA loot boxes court trials. The Netherlands’ District Court ruled the game’s loot boxes system as a stand-alone game of chance that could be accessed and used separately from the FIFA matches.

Person Writing on a Sheet of Paper

In response, EA argued that the packs had to be considered as adding an element of chance to an, otherwise, a game of skill. The entertainment company also suggested that the authorities consider that most of the EA loot boxes are obtained through gameplay by winning a match. Therefore, only a small percentage of those packs are bought using real money.

The gaming company also argues that the theoretical possibility that EA loot boxes are opened and their rewards sold should not be sufficient enough to classify the packs as a stand-alone game of chance. The Dutch court overturned an $11 million fine against Electronic Arts’ FIFA Ultimate Team packs (the EA loot boxes). Eventually, the entertainment company appealed against the decision and won the case, but the movement against the loot boxes was there to last.

The Government Is Considering Banning Loot Boxes

Following the case with the EA loot boxes, representatives of six political parties in the Netherlands have filed a motion calling for stricter regulation of loot boxes in video games or even banning them completely. The motion describes that most loot boxes in the Netherlands are addictive and designed to “manipulate children” into spending money and even “disrupt families.”

Overall, it seems as if the public and political desire to ban the practice in the Netherlands is quite widespread. Such a move poses a threat to companies that have become overly reliant on loot boxes as a steady source of revenue.

Gavel and a Book on Top of Money

Furthermore, the Netherlands Online Gambling Association argues that the loot box games are designed in such a way to actively stimulate microtransactions from its users. This can be very dangerous, especially when promoting products directly to youngsters and children, which have little to no experience with the dangers of online game purchases.

Many games continuously present new cosmetic items to their player base; the only way to obtain them is by purchasing loot boxes. Of course, most titles offer a free-to-play way of buying the loot crates, but that is often designed to take some “heavy game grinding.” Meanwhile, a tasty bundle of loot boxes is just one transaction away.

A Gift Box with a Present

Despite those six parties calling the government to amend the law regarding the view on loot boxes in the Netherlands, only time will tell if their efforts were or were not in vain. Nevertheless, many local newsletters and media believe that the said law amendment will happen, as other nearby countries like France, Belgium, and the UK have already taken that step.

Besides the EA loot boxes in FIFA, many other popular multiplayer games also offer microtransactions, including loot crates. Because of that, in the following section of our blog post, we will look at some of the top titles that come to mind. To provide you with an overall view of what to expect, we have prepared a short table with the most sought-after loot boxes games in the Netherlands below:

Popular Loot Boxes Games in the Netherlands
👹 Diablo Immortal
👼 Lost Ark
📛 Overwatch ✔️
🛳️ World of Warships ✔️
⚽ FIFA

Diablo Immortal – Mobile/Computer RPG

After discussing the EA loot boxes lawsuit and their legality, we must continue with another blockbuster from the online gaming industry, namely Blizzard Entertainment’s Diablo Immortal. The game was first released only on mobile but was soon made available for computers as well.

Purchasing Diablo Immortal Loot Boxes

Because Diablo Immortal was initially designed for the mobile market, it was made in the fashion of heavily relying on microtransactions. Among those purchasable items, players can obtain Diablo Immortal loot boxes that might include currencies, items, boosts, and more. Unlike when refraining yourself from getting extra bonuses at some of the top online casinos in the Netherlands, you simply cannot fully experience the game without the Diablo Immortal loot boxes.

Many fans of the franchise disliked the pay-to-win micro transactional structure of Diablo Immortal, and it quickly became a discussed topic within the gaming community. Soon after the game’s release, some countries also took a public stance against the Diablo Immortal loot boxes system. Currently, the game is unavailable in the Netherlands, and Dutch players cannot download it from Battle.Net, the App Store, or the Marketplace.

Lost Ark – MMORPG

Lost Ark is a South Korean free-to-play MMORPG where players take on a journey through a magical and mysterious world in search of legendary shards of the Lost Ark. The game skyrocketed in popularity on its release due to Twitch streamers broadcasting their early access gameplay. As the game got released to the public, many named it yet another “pay-to-win” title.

Opening Lost Ark Loot Crates

Unfortunately, players in the Netherlands cannot access it due to the Lost Ark loot boxes system. Opening in-game loot crates for real money is really impactful on the gameplay, and if you want to be competitive in the game, you simply cannot do so without spending quite a lot of cash. For that reason, the Netherlands Online Gambling Association, similarly to Belgium, has restricted access to the game.

Overwatch – FPS

Similarly to the previous games, players in the Netherlands cannot purchase loot boxes due to restrictions implemented by the country’s gambling authority. As with the previous titles, Dutch players were able to use real money to buy Overwatch loot boxes, which contain sprays, hero skins, emotes, and other cosmetics.

Opening Overwatch Loot Boxes

However, unlike Diablo Immortal and Lost Ark, the Overwatch loot boxes provide only cosmetic collectables. That means that opening such crates does not impact your gameplay or progress in any way, and everyone remains equal.

Nevertheless, Blizzard announced that it would no longer sell such crates for real money, but you can obtain Overwatch free loot boxes by simply playing the game. Since that philosophy of having free-to-play in-game loot boxes does not interfere with responsible gambling in the Netherlands, the feature remains available to this day.

World of Warships – Simulator

Finally, let us wrap up this section by addressing the World of Warships game. As you have seen, many big companies and gaming titles have experienced restrictions or outright exclusion from the Dutch market. However, the case with the World of Warships loot boxes is slightly different as they are available for purchase in the Netherlands.

World of Warships Loot Boxes

The main difference between the World of Warships loot boxes and, for example, the Diablo Immortal loot boxes is that they are not absolutely essential for the gameplay. Mostly the obtainable crates provide players with different cosmetics such as flags, paints, collector items, and others.

The main reason for their “legality” is that WOWs clearly postulate beforehand what will be available in the box. When the guaranteed content in the crate is at least worth the price you pay, the service and product do not fall under the gambling law restrictions.

Loot Boxes in the Netherlands – A Case by Case Situation

Loot boxes in the Netherlands have been a topic of discussion and interest for quite some time now. As selling and offering loot boxes is technically still not illegal, the Netherlands Online Gambling Association takes a case-by-case approach towards individual games and services. Nevertheless, the six parties have brought up the case to the Dutch parliament, and new laws might be enacted soon.

FAQ

We sincerely hope we have successfully managed to provide insight into the latest developments with the loot boxes in the Netherlands. Nevertheless, we would like to use this final moment to look at some of the most frequently asked questions and answer them for you.

1️⃣ What is a loot box?

To provide you with a short loot box summary, we must first start by saying that it is a feature found at many modern online multiplayer games. For the exchange of in-game currency or real money, players can obtain a digital crate that holds collectables such as skins, items, mounts, boosts, and other cosmetics.

2️⃣ Are loot boxes legal in the Netherlands?

To be perfectly candid, loot boxes are currently legal in the Netherlands. However, the Netherlands Online Gambling Association has taken a case-by-case approach and reviews games with loot boxes separately. Because of that, Dutch players can have access to some loot boxes rather than others.

3️⃣ Is the Dutch government attempting to ban loot boxes in the Netherlands?

There are six political parties that are advocating for the Dutch government to ban loot boxes or at least regulate them tightly. This movement has an ever-growing support from the public, and the loot boxes in the Netherlands will likely become unavailable to purchase with real money.

4️⃣ Are there any loot boxes available in the NL?

We can confirm that there are some popular games with loot boxes available in the Netherlands. For example, the multiplayer game World of Warships presents its players with the option to purchase loot boxes that include flags and other cosmetics. However, customers are always guaranteed to receive the actual value they had paid for.

5️⃣ Can Dutch players obtain loot boxes in Overwatch?

Yes, players in the Netherlands are still able to acquire Overwatch loot boxes. Nevertheless, Blizzard’s FPS game has removed the option to purchase loot boxes for real money due to the Netherlands Online Gambling Association. Instead, Dutch players can use their in-game currency, earned by playing the game, to obtain loot crates.

Moorman is known as one of the biggest online crushers of all time but has $6.5 million in Hendon Mob-reported earnings to prove he’s no stranger to success in the live realm. The Brit will look to add seven figures to his lifetime earnings if he can use his big stack to make a deep run in the PSPC.

There was no shortage of big names that made it to the end of Day 1, including European Poker Tour (EPT) champions like Roberto Romanello and Martin Jacobson, as well as Jacobson’s fellow World Series of Poker (WSOP) Main Event champs Chris Moneymaker, Ryan Riess, Espen Jorstad, Greg Raymer and Scott Blumstein and PokerStars Pros Sam Grafton, Andre Akkari, Arlie Shaban, Benjamin Spragg, Lali Tournier and Alejandro Lococo, who won a big pot in one of the final hands of the night to bag a stack of 204,000.

Defending champion Ramon Colillas, who took down the 2019 PSPC for $5.1 million after spinning up a Platinum Pass freeroll, is still alive after a day battling at a table that included chess pro Alexandra Botez. The popular streamer, who has played poker on Hustler Casino Live and other streams, held her own among the poker pros on the feature table and ended the night with 39,000.

Plenty of Platinum Pass winners are looking to follow in Colillas’ footsteps by taking down the Players Championship. Among the Platinum Pass winners who bagged are Chad McVean, Alexander Herrmann, Dinesh Alt, Xavier Robert Ros and Antonio Ramon Munoz.

Read about some early highlights in Day 1 of the PSPC

Day 1 Action

The energy inside the Baha Mar Resort convention center was palpable as Bruce Buffer kicked things off with his unmistakable “Shuffle up and deal!” announcement.

It didn’t take long for chips to exchange hands and seats to open up as plenty of notable hands made up the first few hours of play.

Alexandru Papazian was one of the first players out after the Romanian grinder suffered a massive cooler in the first few minutes of play. Papazian held pocket jacks and wound up with jacks full on the river, only to find himself against the kings full of Platinum Pass winner Hugo Rodilla, who held pocket kings to deliver a sneaky and sickening beat to Papazian. PokerNews wrote about that hand and others, which you can read about here.

Alexandru Papazian

Moneymaker delivered a comparably brutal beat to Sergio Coutinho when the 2003 Main Event champ held the nut flush against Coutinho’s second nut flush.

Other players who made early exits include PokerStars Ambassador Fintan Hand, Robbi Jade Lew, Kevin Rabichow, Nick Petrangelo and 2019 PCA champ Chino Rheem.

The always-mouthy Shaun Deeb was eliminated shortly before dinner break just a few hands after telling those at the table that they play “so bad” as Platinum Pass winner Lucas Pignay rivered a gutshot straight to have the last laugh.

PokerStars’ Lex Veldhuis made it to the final level of the day before he three-bet jammed with ace-jack only for Lauro Artmann to wake up behind him with Big Slick. Veldhuis was left with crumbs and lost it on the next hand when fellow PokerStars team member Shaban scored a double knockout with pocket queens against the jacks of Ante Jukic and king-ten of Veldhuis.
